Scope of the contract

DNX Network SARL aims to facilitate the use and payment of webcam services – referred to as Content Service – provided by third parties – referred to as “Webcamer(s)” as follows.

DNX Network SARL provides you with access to the Webcamer’s Content Service, and the ability to pay for the Content Service through its technical platforms, referred to as Support Services as follows.

The fees paid by you include the Content Service and the Support Service. DNX Network SARL transfers the paid Content Service Fees to the Webcam in order for it to provide the Content Service to you, and also receives the Fees for the Support Service on its own account in order to provide the Content Service to you. For your convenience, DNX Network SARL may use simplified payment options provided by third parties for the execution of the payment transaction, such as telephone and credit card companies, or the electronic payment organizations.

Rates and Fees

DNX Network SARL guarantees unlimited access to your account. As many Content Services may be purchased as the number of credits in the User’s account allows. The User can purchase credit packs via the website by following the procedure indicated herein.

The user can only use his credits with DNX Network SARL. These credits cannot be transferred to third parties or used in any other way, for example by purchasing services or goods from other parties.

You can also choose the auto pack option. By confirming this option, you authorize DNX Network SARL to automatically repeat the purchase of your last pack while using a Webcamer’s Content Services. The credits on your account are therefore automatically increased. You can deactivate this option at any time in «Your account».

If no credits are placed on the account for 3 months, DNX Network SARL will charge a monthly amount of 10 credits from the 4th month to keep the account active. When there are 0 credits on the account, this debit will no longer be applied.

DNX Network SARL reserves the right to change the services and prices of its website at any time, and as a result change, update or supplement the provisions of this user contract. You are requested to check this user contract regularly. If you continue to use this website after these changes take effect, you acknowledge and accept these changes.

In addition, DNX Network SARL can in no way be held liable for the potentially harmful consequences of changes to the website, or the user contract.

Limited Liability

DNX Network SARL makes every commercial effort to keep its Support Service permanently available, and to secure the website by all available commercially reasonable means. DNX Network SARL takes all measures to limit the inconvenience caused by technical problems.

However, DNX Network SARL cannot rule out the possibility of unintended technical actions or prohibited interventions, or the introduction of viruses. For these reasons, DNX Network SARL cannot guarantee that access to the Support Service will not be interrupted or will not be hindered in any way. As a result, DNX Network SARL cannot be held liable for errors, functional failures, incidents and problems that the use of the Support Services may cause.

In addition, you acknowledge DNX Network SARL’s right to interrupt access to the Support Services, detect and remove any fraud or misuse, and correct any technical, functional or operational defects without notice. The aforementioned interruptions are necessary to change or improve the Support Services, and to ensure regular technical maintenance of the service. DNX Network SARL can in no way be held liable for any damage that you may incur as a result of these interruptions.

Not liable for technical damage

DNX Network SARL cannot be held liable for any harm or damage that you may incur as a result of using any Content Service made possible by this Support Service. In addition, you acknowledge and agree that any downloading of data through the Website, or in any other way, is your sole responsibility and at your own risk. You are solely responsible for any damage to your computer, or loss of data as a result of downloading data.

Not liable for third-party hyperlinks

Websites operated in whole or in part by third parties may contain links to this website. DNX Network SARL does not know the content of these websites, and has no influence or power over the content or other features of these websites.

Technical demands

Use of the Content Service provided by the Webcam may be subject to some technical requirements. The format in which the images of the Content Service are provided, as well as the required video and audio equipment and the internet connection are indicated on the website. If you do not meet the technical requirements, you may not be able to access the Content Service. In addition, for reasons of protection for your computer, you may not be able to use the Content Service.

Obligations as a user

You must be at least 18 years of age, or older where required by law in your country, to be legally permitted to use the Content Service.

Notwithstanding the provisions of other terms of use, you as a user must in particular:

– Use this website in good faith, in a reasonable manner in accordance with these terms of use.
– Do not use any equipment, software or routine to influence, or attempt to influence, the proper functioning of this website. In addition, you will not take any action that will unreasonably or excessively burden the infrastructure of this website (and thereby potentially cause temporary or permanent unavailability), or misrepresent its content.
– Do not use the website for any prohibited purpose or with the aim of causing damage to the reputation of DNX Network SARL or third parties

You acknowledge and agree that the contents of the DNX Network SARL website, including but not limited to the text, photographs, illustrations, described technologies, logos, icons and software, in any form, on any medium and technology is protected by Intellectual and/or Industrial Property Rights, including without limitation copyrights, commercial trademarks, data file rights, trade names, domain names, know-how, models, logos and drawings. DNX Network SARL retains all rights to these elements.

The use of this website does not entitle you to the content. You have no right to modify, adapt, publish, distribute or exploit any part of this website in any way, in whole or in part. You may not insert or enter a link from this website to any other website belonging to you, your employer, or any other third party, or maintained or operated by you, your employer, or any third party without the prior written consent of DNX Network SARL.

You have no rights to the downloaded material. Any modification, adaptation, publication, transfer of downloaded material for purposes other than your own, non-commercial use is strictly prohibited without the express written consent of DNX Network SARL.

Protection of privacy and personal data

DNX Network SARL takes all possible measures to protect the personal data you communicate. Here you will find a link to our Privacy Policy.

By agreeing to these terms of use, you authorize us to retain the last four digits of your registered card number  for an unlimited period of time for future payments and to charge all amounts owed through a subscription and related services, as explained above. with the stored information (in accordance with the cancellation and refund policy included in the terms of use). You are further informed that if any of the above terms in the terms and conditions are changed, we will contact you and inform you of the change(s). As a result, it is your responsibility to ensure that the contact details you provide to us are correct. To contact us, please use the information found in the footer of our most recent posts. You can revoke this consent at any time by simply contacting us via the contact form.

Saving the communication information

If you want to use the chat room, or the other possibilities for interactive communication, you accept that this information is stored. DNX Network SARL will store this information as needed to resolve disputes, provide assistance and investigate issues within the framework of the law. DNX Network SARL will not share this information with third parties, except at the request of the police, or other government representatives in the context of a criminal investigation or suspected illegal activity.

Legal Validity and Terms of Use

If one of these terms of use proves to be invalid or inapplicable, this will not affect the validity or applicability of the other terms and conditions. Any provision that appears to be invalid and/or inapplicable in whole or in part will be replaced by an appropriate, valid provision, which takes over as much as possible the main points of the invalid provision.

Applicable Law and Jurisdiction

This user contract is governed by Luxembourg law. Any dispute arising out of or relating to the use of our website, or arising out of the acceptance, interpretation or respect of these terms of use and/or the privacy regulations shall be submitted exclusively to the Luxembourg courts which shall apply Luxembourg law, with the exception of the rules in the field of international privacy law.

Refunds and Complaints

Since we deliver digital content via an intangible medium, credit packs are not refundable once consumption has started. By confirming the purchase, the customer confirms that the delivery has started in accordance with article 16 of the EU directive 2011/83/EU. DNX Network SARL will therefore only refund individual credits and only if there was a technical problem with the DNX Network SARL platform that prevented the digital content from being available to the customer. Complaints may be sent to support@dnxnetwork.lu.

18 U.S.C 2257 Record-Keeping Requirements Compliance Statement

In compliance with the Federal Labeling and Record-Keeping Law (also known as 18 U.S.C. 2257), all models located within our domain were 18 years of age or older during the time of photography. All models’ proof of age is held by the custodian of records, which is listed below, organized by producer. All content and images are in full compliance with the requirements of 18 U.S.C. 2257 and associated regulations.
